Term and Condition

1. SHIPPING PROCEDURE
a) Shipments will only be picked up if booked through the Kaprix Power House Logistics Customer Portal, Booking App, or API Service.
b) The minimum chargeable weight is 0.5 kg.
c) GST is applicable on the above-mentioned rates, as per the province.
d) In the event a customer refuses to accept the shipment for any reason, the shipment will be returned to the merchant with a new consignment note, and return charges will apply.
e) If the shipment’s volumetric weight exceeds its actual weight, the shipment weight will be calculated as follows (all measurements in centimeters):
(Length x Height x Width)/5000 (Length x Height x Width) / 5000 (LengthxHeightxWidth)/5000
f) No shipment processed under the COD procedure is insured by Kaprix Power House Logistics unless the merchant has specifically opted for insurance.
g) Packaging:
You are responsible for packing your goods. Please ensure your product is properly packed to ensure safety during transit, in accordance with the nature of the goods. Kaprix Power House Logistics will not be responsible for any damage caused to the product due to poor packaging.
h) Documents Required for Account Opening:
- Bank account title (to issue your cheque).
- Client’s name or corporate name.
- Office address or pick-up address.
- CNIC copy.
- Contact person.
- Designation.
- Contact numbers and email address.
2. LIABILITY AND LIMITATION OF DAMAGES
a) Kaprix Power House Logistics will not be responsible for any shortages claimed by the consignee. It is the client’s responsibility to ensure the exact number of items inside the parcel, as the quantity inside the parcel is not known to Kaprix Power House Logistics.
b) The client is responsible for the packing of goods to ensure their safety during transit, based on the nature of the goods. Any damage to the product due to poor packaging will not be Kaprix Power House Logistics responsibility.
3. NOTICE OF CLAIM AND FILING OF SUIT
a) Claims for damages to the shipment will not be admissible. Any damages occurring during transit will be the responsibility of the client. The client must ensure proper packing of fragile and sensitive items.
b) Claims will only be admissible for shipments lost in transit within Pakistan due to accident, theft, snatching, or robbery. Claims will not be admissible if the seal of the package or flyer is broken or torn.
c) Kaprix Power House Logistics will not be responsible for any shortages claimed by the consignee. It is the client’s responsibility to ensure the correct quantity of items inside the parcel, as the contents are not known to Kaprix Power House Logistics. No claims will be entertained if a shipment is delivered to the consignee in acceptable condition.
d) Kaprix Power House Logistics settlement of a claim against a shipment cannot exceed the retail value of the product(s) being shipped. For insured shipments, the claim will be settled up to the insured value declared by the client on the consignment note. Claims will only be accepted if the insurance premium has been fully paid by the client.
e) For insured shipments, the client must accept the insurance terms and conditions of Kaprix Power House Logistics before the shipment is handed over to the company. No eligibility will be entertained after the shipment has been booked.
f) Claims will not be admissible for damage to goods, including electronic equipment (e.g., LCD, LED). The client is responsible for packing such products properly.
g) Claims will not be admissible if a shipment is lost due to:
- War, strikes, or riots.
- Terrorism.
- Explosions.
- Earthquake, fire, or shock.
h) A legitimate claim will be settled within two weeks from the date of the incident.
i) Proof of delivery, if required by the customer, cannot be provided for shipments that were booked more than 90 days prior to the request.
4. LIABILITY FOR CONSEQUENTIAL DAMAGES
a) Kaprix Power House Logistics shall not be liable for any loss of profit or any special, indirect, or consequential damages of any kind.
5. CONDITIONS OF CARRIAGE
a) Goods are carried under the rules established by the Carriage By Air Act of 1934 (XXX of 1934), as adopted and modified by the Central Government of Pakistan for domestic carriage (14th March 1962). Carriage under this consignment note and other services provided by the carrier are subject to the following conditions:
- The consignor must provide all necessary information and documents to meet customs, octroi, or police formalities before the cargo can be delivered to the consignee. The consignor is liable for any damage caused by the absence, insufficiency, or irregularity of any such documents or information.
- The consignor is responsible for the accuracy of the particulars and statements related to the cargo that are provided in the air consignment note.
b) Receipt by the person entitled to the delivery of cargo without complaint is considered prima facie evidence that the cargo has been delivered in good condition and in accordance with the contract of carriage.
c) The carrier is not liable for any damage, delay, or loss arising out of or in connection with the carriage of the goods unless such damage is caused by the negligence or willful fault of the carrier, and there has been no contributory negligence by the consignor, consignee, or other claimant.
d) The carrier is not liable for any damage arising out of compliance with laws, government regulations, orders, or requirements, or for any cause beyond the carrier’s control.
e) In the carriage of cargo, the liability of the carrier in respect of destruction, loss, or damage is limited to Rs. 88.20 per kg unless the consignor makes a special declaration of the value and pays a supplementary sum.
f) The carrier’s liability for damage caused by delay in the carriage of goods is limited to actual damage sustained due to the delay, or double the sum paid for carriage, whichever is smaller.
g) The carrier is not liable for damage caused by goods that endanger aircraft, persons, or property. The carrier may abandon or destroy goods at any time without liability.
6. KAPRIX POWER HOUSE LOGISTICS Customer Registration Form
By opening an account with Kaprix Power House Logistics, the Shipper/Client acknowledges and accepts these terms and conditions and releases Kaprix Power House Logistics from any liabilities, responsibilities, claims, proceedings, suits, etc., arising from damage, loss, or expense in connection with the services provided. The Shipper/Client further agrees that Kaprix Power House Logistics is only responsible for the carriage of documents/parcels and is not liable for the contents.
7. ADDITIONAL TERMS
a) KAPRIX POWER HOUSE LOGISTICS Consignment Note:
The Consignment Note of Kaprix Power House Logistics (CN) is non-negotiable. The Shipper/Client acknowledges that the CN has been prepared by them or by Kaprix Power House Logistics staff on their behalf. The Shipper/Client confirms that all information provided, including shipper and consignee details, goods value declarations, etc., is complete and accurate. Kaprix Power House Logistics is not liable for any loss, damage, or expense caused by incorrect information or declarations.
b) No Variation:
These terms and conditions apply to all courier and logistics services provided by Kaprix Power House Logistics. No employee, franchisee, agent, or anyone else has the authority to alter, modify, or waive any of these terms.
c)Acceptance Process:
The acceptance process for shipments booked via the Kaprix Power House Logistics Business Portal (Beta Portal) is governed by specific terms. When a shipment is booked, the shipper acknowledges that Kaprix Power House Logistics assumes no liability for the contents, as Kaprix Power House Logistics does not inspect or open the shipments, especially for high-value items. The shipper is fully responsible for ensuring compliance with all applicable laws and regulations.
d) Lien on Goods Shipped:
Kaprix Power House Logistics has a lien on any goods shipped for all freight charges, octroi duties, advances, or any other charges payable by the Shipper/Client. Kaprix Power House Logistics may refuse to surrender possession of the goods until such charges are paid.
e) Liabilities Not Assumed:
Kaprix Power House Logistics is not liable for any delay in pick-up, transport, or delivery of any shipment, regardless of the cause. Kaprix Power House Logistics shall also not be liable for any loss, damage, or mis-delivery caused by circumstances beyond its control, such as natural disasters, war, or government actions.
f) Claims:
Any claim must be submitted by the Shipper/Client in writing within seven days of the shipment’s acceptance. Claims will not be entertained if transportation charges have not been fully paid.
h) Material Not Acceptable for Transportation:
Kaprix Power House Logistics will not carry liquids, liquor, firearms, plants, contraband drugs, explosives, animals, perishables, negotiable instruments in bearer forms, obscene materials, industrial carbons, diamonds, IATA restricted items, or any other item prohibited by law.
i) Payment Mode:
Payment must be made via a cross cheque in favor of Universal Network Systems (Pvt.) Limited. Kaprix Power House Logistics is not liable for losses if payment is made through cash or any other method.
j) GST and Rates:
GST will be applicable as per government regulations. Rates will be increased annually by mutual agreement.
By opening an account with Kaprix Power House Logistics, the Client/Shipper agrees to these terms and conditions.
